1. Acceptance of Terms

By accessing or using iLive ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. iLive reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Service Description

iLive provides a platform for creating and managing online memorials for deceased loved ones. The Service includes:

• Creation of memorial profiles with biographical information, photos, videos, and tributes
• Collaborative management with family and friends through role-based access
• QR code generation for gravesite access
• Guestbook functionality for leaving tributes and messages
• Privacy controls and moderation tools

iLive is a memorial platform and not a substitute for professional grief counseling or legal services. We do not verify the accuracy of user-submitted content.

3. Eligibility

You must be at least 13 years old to use the Service. By using iLive, you represent and warrant that you meet this age requirement.

If you are creating a memorial for a deceased individual, you represent that you have the legal right and authority to do so, or that you are an authorized family member or representative.

4. Account Registration

To create a memorial, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with others

iLive reserves the right to refuse service, terminate accounts, or remove content at our sole discretion.

5. User Content

You retain ownership of all content you submit, post, or display on iLive ("User Content"). By submitting User Content, you grant iLive a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of operating and improving the Service.

Content Responsibility

You are solely responsible for all User Content you submit. You represent and warrant that:

• You own the content or have permission to use it
• The content does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights
• The content is appropriate and respectful for a memorial context

Content Moderation

iLive reserves the right, but not the obligation, to monitor, review, and remove any User Content that violates these Terms, is inappropriate, or is otherwise objectionable. We may also moderate content to ensure compliance with our Community Guidelines.

6. Prohibited Conduct

You agree not to use the Service to:

• Post or share content that is hateful, harassing, discriminatory, or promotes violence
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Post private or confidential information without authorization
• Upload viruses, malware, or other malicious code
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service for any illegal purpose
• Interfere with or disrupt the Service or servers
• Create memorials for living individuals or submit false information
• Use automated systems to access the Service

7. Intellectual Property

The Service, including its code, design, layout, graphics, and logo, is owned by iLive and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

iLive, the iLive logo, and other iLive trademarks are property of iLive. You may not use these trademarks without prior written consent.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

9. Payments & Subscriptions

iLive offers both free and paid premium plans. By purchasing a premium subscription, you agree to:

• Pay all fees associated with your chosen plan
• Provide accurate payment information
• Authorize recurring charges for subscription plans

Refund Policy

Subscription fees are non-refundable except as required by law. If you cancel your subscription, you will continue to have access until the end of your current billing period.

Price Changes

We reserve the right to change our pricing at any time. Price changes will be communicated in advance and will not affect your current subscription period.

10. Termination

You may delete your account at any time by contacting support. Upon termination:

• Your memorial pages will be removed from public view
• You may export your content before deletion
• We may retain certain information as required by law

iLive reserves the right to suspend or terminate your account for violation of these Terms, without prior notice. In such cases, refunds for prepaid fees will not be issued.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. iLive DOES NOT WARRANT THAT:

• The Service will function uninterrupted, secure, or available at any particular time
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components

iLive is not responsible for user-submitted content or for any actions taken by users. Memorial content is provided by users and does not reflect the views of iLive.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, iLive SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL iLive'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO iLive, IF ANY, DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

13. Indemnification

You agree to defend, indemnify, and hold harmless iLive and its employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your content caused damage to a third party

14. Modifications to Service

iLive reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.
